Copy right is a contract between the performers/writers etc and the audience. The audience gives the performers monopoly rights for a given time period during which the performers can require the audience to pay up if they want to experience the performance. At the end of the given time period the monopoly rights are lost and the performance becomes public domain.
Now some performers want to renege on the deal.
Remember, Singing 'Happy Birthday' may be part of our culture but it's chargable.
